KOAACH GLOBAL REFUND & CANCELLATION POLICY

1. PURPOSE AND SCOPE

This Refund & Cancellation Policy explains the circumstances in which Koaach may provide cancellations, credits, refunds or other remedies for paid products and Services offered through www.koaach.com and associated Koaach applications and Services.

Koaach is operated by SIEGER TRAINING INDIA, an India-based entity serving users globally. This Policy applies to purchases made directly from Koaach. Where Koaach only facilitates a connection and the organisation contracts directly with a trainer or other professional, the commercial terms between those parties may govern the underlying service.

Nothing in this Policy excludes or limits any mandatory consumer or statutory right that applies to you.

3. IMPORTANT PRINCIPLE — SPECIFIC TERMS PREVAIL

The refund terms shown clearly before checkout, in a quotation, booking confirmation, invoice, subscription plan, order, service agreement or other written commercial document may provide specific cancellation or refund rules for that transaction. Those specific terms will apply to the extent they are lawful and expressly applicable.

Where no specific terms are provided, this Policy applies.

4. TYPES OF KOAACH PURCHASES
  • Platform subscriptions and memberships;
  • Digital products, downloadable resources or online content;
  • Paid platform features or professional services;
  • Trainer, coach or facilitator bookings where Koaach collects or administers payment;
  • Organisation Services or managed programme services offered by Koaach;
  • One-time purchases;
  • Other paid Services introduced by Koaach.
5. BEFORE YOU PURCHASE

Koaach aims to present material information before purchase, including the nature of the Service, price, applicable taxes or charges where known, subscription frequency where applicable, and relevant cancellation or refund conditions.

Users should review the purchase page, quotation, order, invoice and applicable terms before completing payment.

6. GENERAL CANCELLATION RULE

If a cancellation right is offered for a particular Service, the customer must submit the cancellation request through the available account mechanism or by contacting hello@koaach.com. The effective cancellation date is generally the date Koaach receives a valid request, unless the applicable contract specifies otherwise.

Cancellation of a recurring subscription normally stops future renewals but does not automatically refund amounts already paid for the current billing period unless the applicable plan or law provides otherwise.

7. SUBSCRIPTIONS
7.1 Customer-Initiated Cancellation

You may cancel a subscription before the next renewal date using the available cancellation mechanism or by contacting Koaach. Unless otherwise stated, cancellation takes effect at the end of the current paid period.

7.2 Renewal

If a subscription renews automatically, the renewal terms and price displayed at purchase or renewal will apply. Where applicable law requires advance notice or consent for renewal, Koaach will provide the required notice or obtain the required consent.

7.3 Refund After Renewal

A renewal payment is not automatically refundable merely because a user did not use the Service. Refunds after renewal will be considered under the applicable plan terms, transaction-specific terms and mandatory law.

7.4 Promotional Plans

Discounted, promotional, trial or introductory plans may have special cancellation and refund conditions. Any such conditions will be disclosed before purchase to the extent required.

8. DIGITAL PRODUCTS AND DIGITAL SERVICES

For digital content or digital Services, refund rights may depend on whether delivery or performance has started, the type of Service, the terms accepted at purchase and the law applicable to the transaction.

Where a jurisdiction grants a statutory withdrawal right, Koaach will honour that right subject to lawful exceptions. For example, EU consumer rules recognise a 14-day withdrawal period for many distance service contracts, while allowing specific exceptions, including certain digital content where performance begins after the required consumer consent/acknowledgement.

Where Koaach provides digital content or a digital Service that is defective or materially non-conforming, mandatory consumer remedies may apply. EU digital-content rules, for example, provide remedies for faulty digital content and digital Services.

9. TRAINER, COACH AND FACILITATOR BOOKINGS

Where Koaach collects payment for a confirmed trainer or learning-professional engagement, the booking confirmation, quotation, agreement or invoice may specify cancellation deadlines, deposits, cancellation charges, rescheduling rights and refund amounts.

Where the organisation contracts directly with the trainer and Koaach is only a discovery or communication platform, Koaach is not automatically responsible for the trainer's refund obligations. Koaach may assist with dispute resolution or payment administration where agreed.

10. ORGANISATION-CANCELLED PROGRAMMES

For programmes involving a trainer, coach, facilitator, venue, materials, travel or other committed resources, cancellation charges may increase as the programme date approaches. Any booking-specific cancellation schedule will prevail if clearly provided.

If no booking-specific schedule exists, Koaach may assess reasonable committed, non-recoverable costs and work already performed, subject to applicable consumer law.

11. TRAINER-CANCELLED PROGRAMMES

If a trainer cancels or cannot deliver a confirmed engagement, Koaach may, depending on the arrangement:

  • assist with rescheduling;
  • assist in identifying an alternative trainer;
  • provide a credit;
  • facilitate a refund of amounts Koaach has collected that are refundable under the applicable terms; or
  • take another commercially reasonable action agreed with the affected parties.

Any refund will depend on the transaction structure and the amount actually collected or administered by Koaach.

12. RESCHEDULING

Where rescheduling is requested, Koaach may permit a change of date or time subject to trainer availability, supplier commitments, booking-specific terms and any reasonable non-recoverable costs. Rescheduling is not necessarily a refund.

13. NO-SHOWS

A customer's failure to attend, participate in or access a scheduled Service does not automatically create a refund right where the Service was available and the failure was attributable to the customer.

If a trainer or Koaach fails to appear or provide a confirmed Service, the customer should contact hello@koaach.com promptly. Koaach will review the circumstances and applicable contractual terms.

14. SERVICE NOT PROVIDED OR MATERIALLY NOT AS DESCRIBED

If Koaach fails to provide a paid Service or the Service is materially different from what was contractually promised, contact us as soon as reasonably possible. Depending on the circumstances and applicable law, Koaach may provide correction, re-performance, credit, partial refund or full refund.

Mandatory local consumer remedies will prevail.

15. DUPLICATE, INCORRECT OR UNAUTHORISED PAYMENTS

If you believe you were charged twice, charged an incorrect amount or charged for a transaction you did not authorise, contact hello@koaach.com with the transaction reference and supporting details.

Koaach may investigate the payment with the relevant payment provider. Verified duplicate or billing-error transactions may be refunded or corrected. Unauthorised transactions may also be investigated subject to payment-provider rules and applicable law.

16. NON-REFUNDABLE FEES

Certain fees may be non-refundable where they are clearly disclosed before purchase and permitted by law. Examples may include:

  • payment-processing charges, where lawfully and transparently passed through;
  • completed or substantially performed Services;
  • custom or specially prepared Services already performed;
  • administrative or platform fees where expressly identified;
  • certain promotional purchases; and
  • third-party costs that Koaach is contractually unable to recover, where applicable and lawfully disclosed.

A fee described as non-refundable cannot override a mandatory statutory refund or cancellation right.

17. PARTIAL REFUNDS

Where only part of a Service was delivered, or where a partial remedy is appropriate, Koaach may issue a proportionate refund, credit or other remedy where permitted by the applicable agreement and law.

18. REFUND METHOD

Approved refunds are generally returned to the original payment method. If the original payment method cannot accept the refund, Koaach may use another lawful method after reasonable verification.

Koaach is not responsible for delays caused solely by banks, card networks, payment gateways or other financial institutions.

19. REFUND PROCESSING TIMES

Koaach will initiate an approved refund without unreasonable delay and within any period required by applicable law. The time for the funds to appear in the customer's account may depend on the payment processor or financial institution.

For EU consumer withdrawals, applicable rules may require reimbursement within 14 days of notification of withdrawal, subject to the conditions and exceptions provided by law.

20. TAXES AND GST

Prices may include or exclude taxes depending on the purchase. Where Indian GST or another transaction tax applies, Koaach will issue appropriate tax documentation and process any tax component of an approved refund according to applicable tax law.

A refund does not necessarily mean that every tax or third-party charge will be refundable; treatment depends on applicable tax law and the transaction.

21. INTERNATIONAL PAYMENTS AND CURRENCY

Koaach may accept payments in different currencies. Refunds are generally processed against the original transaction. Exchange-rate movements between payment and refund may mean that the amount received in the customer's local currency differs from the original amount.

Bank, card, payment gateway and foreign-exchange fees may be outside Koaach's control. Any treatment of such fees will be subject to the applicable transaction terms and law.

22. EU / EEA CONSUMER RIGHTS

Where EU consumer law applies, Koaach will recognise applicable mandatory rights, including applicable pre-contract information, withdrawal and digital-service remedies. Many online service contracts have a 14-day withdrawal period, subject to exceptions. Consumers may have remedies where digital services are faulty or not supplied as agreed.

Where a consumer requests that a Service begin during the withdrawal period, the consequences for withdrawal may depend on the applicable law and the extent of performance already provided. Koaach will provide any legally required information and obtain any legally required acknowledgement.

23. UNITED KINGDOM

Where UK consumer law applies, Koaach will respect applicable statutory cancellation, refund, digital-service and unfair-contract-term protections. The applicable rights may vary according to the nature of the Service and whether the customer is a consumer or a business.

24. INDIA — CONSUMER PROTECTION

Koaach is operated from India and will comply with applicable Indian consumer-protection and e-commerce requirements to the extent applicable. India maintains the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020, among other related rules.

Koaach will provide applicable grievance and refund mechanisms required by law. Indian e-commerce rules include obligations concerning consumer consent and refunds, and current government materials state that e-commerce entities are expected to maintain grievance mechanisms.

25. UNITED STATES AND OTHER JURISDICTIONS

Refund and cancellation rights in the United States and other jurisdictions vary by state, country, transaction type and whether the purchaser is a consumer or business. Koaach will not contractually waive mandatory rights that apply to the transaction.

Where local law requires a specific cancellation period, refund, remedy or disclosure, that requirement will apply to the extent legally applicable.

26. BUSINESS CUSTOMERS

Many Koaach transactions may be business-to-business. Where an organisation purchases Services for commercial purposes, the agreed quotation, purchase order, master services agreement, booking terms or other commercial contract may establish the cancellation and refund rules.

Mandatory consumer protections generally apply only where the purchaser qualifies as a consumer under applicable law.

27. CHARGEBACKS AND PAYMENT DISPUTES

If you believe a refund is due, please contact Koaach before initiating a chargeback where reasonably possible so that we can investigate and resolve the issue.

Nothing prevents a customer from exercising a lawful right to dispute an unauthorised or improper transaction through a payment provider or applicable legal process.

28. FRAUDULENT OR ABUSIVE REFUND REQUESTS

Koaach may investigate suspected fraud, abuse, manipulation or repeated improper refund claims. Where permitted by law, Koaach may refuse a claim that is fraudulent or outside applicable terms and may suspend accounts associated with serious abuse.

This does not limit genuine statutory consumer rights.

29. FORCE MAJEURE AND EXCEPTIONAL EVENTS

Where a Service cannot be delivered because of events outside reasonable control, such as natural disasters, severe infrastructure failures, government restrictions, war, civil unrest, epidemics, transport disruption or other force majeure events, Koaach may offer rescheduling, credit, alternative delivery or refund depending on the circumstances and applicable contractual terms.

Mandatory legal rights remain unaffected.

30. DISPUTES BETWEEN TRAINERS AND ORGANISATIONS

Koaach may facilitate communication or dispute resolution but is not necessarily a party to an agreement between an organisation and trainer. Parties should first attempt to resolve disputes directly under their engagement terms.

Where Koaach has collected or administered funds, Koaach may hold, release, credit or refund funds according to the applicable agreement and law.

31. CANCELLATION REQUEST PROCEDURE

To request a cancellation or refund, email hello@koaach.com with:

  • full name or organisation name;
  • registered email address;
  • order, booking, invoice or transaction reference;
  • Service or subscription purchased;
  • purchase/booking date;
  • requested cancellation or refund date;
  • reason for the request where relevant; and
  • supporting information or documents where necessary.

Koaach may request additional information to verify the transaction and protect against fraud.

32. REFUND DECISION

Koaach will review each request under the applicable purchase terms, this Policy, the transaction structure and mandatory law. Approval of one refund does not establish an automatic entitlement to identical refunds in unrelated transactions.

33. CREDITS AND ALTERNATIVE REMEDIES

Where appropriate and lawful, Koaach may offer a credit, rescheduling, replacement Service, partial refund or other remedy instead of a cash refund. A customer is not required to accept an alternative remedy where mandatory law provides a cash refund or other statutory remedy.

34. RECORDS

Koaach may retain records of refund requests, payment transactions, communications, decisions and supporting documentation for accounting, legal, fraud-prevention, customer-support and compliance purposes, subject to applicable privacy laws and retention requirements.

35. CHANGES TO THIS POLICY

Koaach may update this Policy to reflect changes in Services, pricing structures, payment methods, legal requirements or business practices. Material changes will be communicated through reasonable means where required.

36. GOVERNING LAW AND MANDATORY RIGHTS

This Policy is operated by an Indian entity and will be interpreted subject to applicable Indian law, while recognising mandatory consumer, contractual and refund rights applicable to users in other jurisdictions.

Nothing in this Policy is intended to exclude, restrict or waive a mandatory legal right that cannot lawfully be excluded or waived.

37. GOVERNING LAW, JURISDICTION AND CONSUMER RIGHTS

This Refund & Cancellation Policy is governed by the laws of India to the extent applicable to the relevant transaction and Koaach's activities.

Koaach is operated by SIEGER TRAINING INDIA, with its registered office in Chennai, Tamil Nadu, India.

Subject to any mandatory consumer, contractual, payment or statutory rights that cannot lawfully be excluded or restricted, any dispute, claim or proceeding arising out of or relating to a refund, cancellation, payment or transaction with Koaach shall be subject to the jurisdiction of the courts located in Chennai, Tamil Nadu, India.

For business-to-business transactions, and to the maximum extent permitted by applicable law, the courts located in Chennai, Tamil Nadu, India shall have exclusive jurisdiction over disputes arising between Koaach and the Organisation or business customer.

For consumers located outside India, nothing in this Policy is intended to exclude, restrict or waive any mandatory consumer-protection, cancellation, refund, withdrawal, payment or statutory rights available under the laws of the consumer's jurisdiction.

Where applicable law provides a consumer with a mandatory right to bring proceedings in their country or place of residence, access a local dispute-resolution mechanism, or exercise another statutory remedy that cannot legally be waived, that right shall prevail.

Nothing in this Policy prevents a customer from exercising any mandatory rights available through their bank, card provider, payment provider, regulator, consumer-protection authority or other lawful mechanism.
